Rights of Dead Person
Rights of Dead Person, The Bombay High Court while listening to the case filed through PIL named Faizan E-Gaus-O-Raza Trust v. Municipal Corporation of Greater Mumbai & Ors held that the right of the dead person to be given respectful and decent last rites is as important as other rights available to a person when he/she is alive.
The Bombay High Court expanding the scope of Article 21 directed the Mumbai Municipal Corporation to provide adequate space for the burial of the dead for which purpose they filed the PIL.
The Court directed to provide an area for burial space at the Deonar Colony, Rafi Nagar, or land near Hindustan Petroleum Corporation Limited to ensure the Rights of a dead person.
Further being informed about the HPC, the Court directed the government to acquire the land near the Hindustan Petroleum Corporation (HPC) under the 2013 Land Acquisition Act which is now a private party.
