The Supreme Court of India has ruled that the principle of res judicata, which prevents the same issue from being litigated multiple times, may not strictly apply in cases where the public interest is at stake. This significant decision came as the court adjudicated a series of land acquisition cases involving the Delhi government and its agencies.
The bench, comprising Justices Surya Kant, Dipankar Datta, and Ujjal Bhuyan, emphasized that a rigid application of res judicata could hinder justice in matters that significantly impact the public. The justices argued that a more flexible approach is necessary when public welfare and interest are involved, ensuring that justice is not only done but also seen to be done.
